How NES annual leave accrual works

Under section 87 of the Fair Work Act 2009, full-time and part-time employees accrue annual leave progressively throughout the year based on their ordinary hours of work. Accrual rate is:

When annual leave does NOT accrue

Annual leave does continue to accrue during paid annual leave, paid personal/carer's leave, paid community service leave, and paid public holidays.

How much annual leave do you accrue in Australia?
Full-time employees accrue 4 weeks of annual leave per year of service under the Fair Work Act National Employment Standards. Continuous shift workers accrue 5 weeks. Part-time employees accrue pro-rata. Casual employees do not accrue annual leave but receive a 25% casual loading instead.
Does annual leave accrue during paid leave?
Yes. Annual leave continues to accrue during paid annual leave, paid personal leave, paid community service leave, and most other paid leave. It does not accrue during unpaid leave such as unpaid parental leave or leave without pay.
Is unused annual leave paid out on termination?
Yes. The Fair Work Act requires employers to pay out the cash equivalent of any accrued but unused annual leave on termination, at the rate the employee would have been paid for taking the leave (including any applicable leave loading).
What is leave loading and do I get it?
Leave loading is an extra 17.5% on top of base pay when taking annual leave, included in most modern awards. Whether you get it depends on your award or agreement. Award-free employees typically don't receive automatic leave loading.
Can my employer force me to take annual leave?
An employer can direct an employee to take annual leave only if the direction is reasonable (e.g. during a shutdown period) and the employee has accrued an excessive amount of leave (often defined as more than 8 weeks). The direction must be in writing.
